Child suspended for texting parent asking to bring him lunch after the AP forced him to throw his out

On Tuesday my son who is a 7th grander at Radloff Middle School was forced to throw away his lunch by the assistant principal after he had accused him of popping a baggy in the cafeteria. Jamison swearington, along with two of his classmates were in the middle of lunch when someone popped a baggy behind him then pointed fingers at them when asked who had done it. As the AP made them remove themselves from the table they were sitting at, he told them they needed to toss their lunch in the trash. My son asked to keep his food for later but was denied the right to do so. The three boys were placed at another table until their teacher came and got them. A counselor for the school then told my son that a lot of kids deny doing wrong, then made him apologize. My son then contacted me via text telling me what happened and asked me to bring him food because he was hungry. Today, two days after the fact, my son came home from school with a referral and 2 days suspension for texting me without permission. His referral also states that this is his second time contacting me while at school without consent from a teacher. The first time happened a few months back when he was having trouble breathing and I had to take him to the ER. Any child should have access to their phone when there is an emergency or if they feel the situation Is not right. My child is a A student who has never been in trouble and I refuse to let this referral go onto his record. Something must be done about this. No Child should go 9-5 without eating. Refusing a child food is illegal and not fair.
